1. Taraflar ve kabul

Bu koşullar, Verinomi Bilişim ("Verinomi") tarafından imapsync.verinomi.com adresinde sunulan e-posta taşıma hizmetinin ("Hizmet") kullanımını düzenler. Hizmeti kullanarak ve eşitlemeyi başlatmadan önce ilgili kutuyu işaretleyerek bu koşulları okuduğunuzu, anladığınızı ve kabul ettiğinizi beyan edersiniz. Koşulları kabul etmiyorsanız Hizmeti kullanmayın.

2. Hizmetin niteliği

Hizmet, açık kaynak imapsync yazılımını kullanarak bir IMAP posta kutusundaki e-postaları başka bir IMAP posta kutusuna kopyalayan, ücretsiz ve teknik bir araçtır. Hizmet "olduğu gibi" ve "mevcut olduğu şekliyle" sunulur. Verinomi; Hizmetin kesintisiz, hatasız, belirli bir amaca uygun olacağına ya da tüm e-postaların eksiksiz ve değişmeden aktarılacağına dair açık veya örtülü hiçbir garanti vermez.

3. Kullanıcının sorumlulukları

Yedekleme: Taşımaya başlamadan önce kaynak ve hedef posta kutularınızın güncel bir yedeğini almak yalnızca sizin sorumluluğunuzdadır.
Yetki: Hizmeti yalnızca sahibi olduğunuz ya da kullanmaya açıkça yetkili olduğunuz hesaplar için kullanabilirsiniz. Başkalarına ait hesaplara yetkisiz erişimden doğan her türlü hukuki ve cezai sorumluluk size aittir.
Doğru bilgi ve seçenekler: Girdiğiniz sunucu, kullanıcı ve seçenek bilgilerinin doğruluğundan siz sorumlusunuz. Önce "Sadece giriş bilgilerini test et" ya da "Deneme modu" ile denemenizi öneririz.
Sonucu kontrol: Taşıma bittikten sonra hedef hesapta e-postaların eksiksiz olduğunu kontrol etmek ve günlükteki hata ve uyarıları incelemek sizin sorumluluğunuzdadır.
Hukuka uygun kullanım: Hizmet; spam, yetkisiz erişim, şifre denemesi ya da herhangi bir hukuka aykırı amaçla kullanılamaz.

4. Silme seçenekleri

"Taşı: kaynaktan sil" ve "Birebir eşitle: hedeften sil" seçenekleri e-postaları kalıcı olarak siler ve geri alınamaz. Bu seçenekleri kullanma kararı ve sonuçları tamamen size aittir.

5. Sorumluluğun reddi

Yürürlükteki mevzuatın izin verdiği en geniş ölçüde Verinomi; Hizmetin kullanımından ya da kullanılamamasından doğan aşağıdakiler dahil ancak bunlarla sınırlı olmamak üzere hiçbir doğrudan veya dolaylı zarardan sorumlu değildir:

e-postaların, eklerin, klasörlerin ya da işaretlerin kaybolması, silinmesi, eksik, bozuk, çift veya hatalı aktarılması;
silme seçeneklerinin kullanılmasının sonuçları;
taşımanın yarıda kalması, gecikmesi veya Hizmette yaşanan kesintiler;
kaynak veya hedef sağlayıcıların (ör. Google, Microsoft, barındırma firmaları) sınırlamaları, kotaları, hesap engellemeleri veya güvenlik önlemleri;
iş kaybı, kâr kaybı, itibar kaybı, veri kaybı ya da üçüncü kişilerin talepleri.

Hizmetin ücretsiz sunulduğunu göz önünde bulundurarak, herhangi bir sebeple Verinomi'nin sorumluluğunun doğduğu kabul edilse dahi bu sorumluluk, kanunun zorunlu kıldığı hâller dışında hiçbir durumda doğmaz. Kasıt ve ağır ihmal hâlleri ile kanunen sınırlandırılması mümkün olmayan sorumluluklar saklıdır.

6. Hizmette değişiklik ve erişimin engellenmesi

Verinomi; Hizmeti, sınırlarını ve bu koşulları önceden bildirimde bulunmaksızın değiştirme, askıya alma veya sonlandırma hakkını saklı tutar. Kötüye kullanım şüphesi hâlinde çalışan eşitlemeleri durdurabilir ve erişimi engelleyebilir.

7. Kişisel veriler

Şifreler kaydedilmez; yalnızca eşitleme süresince bellekte tutulur. E-posta içerikleri diske kaydedilmez. Aşağıdaki kayıtlar tutulur:

İşlem günlüğü (sunucu adları, kullanıcı adları, klasör adları, hata mesajları): destek vermek amacıyla tutulur, 7 gün sonra otomatik olarak silinir.
Onay kaydı (tarih ve saat, IP adresi, kaynak ve hedef hesap adresleri ile sunucuları, seçilen seçenekler, kabul edilen koşulların sürümü ve eşitlemenin sonucu): bu koşulların kabul edildiğini ispat etmek, olası uyuşmazlıklarda hukuki hakları korumak ve kötüye kullanımı önlemek amacıyla tutulur, 2 yıl sonra otomatik olarak silinir.

Bu kayıtlar üçüncü kişilerle paylaşılmaz; yalnızca yasal bir zorunluluk hâlinde yetkili makamlara verilebilir.

Bu koşullar Türkiye Cumhuriyeti hukukuna tabidir.

In short: The service is free and provided "as is". Backing up your email before migrating is your responsibility. Verinomi is not liable for any damage, including data loss, incomplete or faulty transfers, and the results of the delete options.

1. Parties and acceptance

These terms govern the use of the email migration service ("Service") provided by Verinomi Bilişim ("Verinomi") at imapsync.verinomi.com. By using the Service and ticking the box before starting a sync, you confirm that you have read, understood and accepted these terms. If you do not accept them, do not use the Service.

2. Nature of the service

The Service is a free technical tool that copies email from one IMAP mailbox to another using the open source imapsync software. It is provided "as is" and "as available". Verinomi gives no express or implied warranty that the Service will be uninterrupted, error-free or fit for a particular purpose, or that all messages will be transferred completely and unchanged.

3. Your responsibilities

Backups: Taking a current backup of the source and destination mailboxes before migrating is solely your responsibility.
Authorisation: You may only use the Service for accounts you own or are explicitly authorised to use. You bear all legal and criminal liability arising from unauthorised access to other people's accounts.
Correct details and options: You are responsible for the accuracy of the server, user and option details you enter. We recommend testing first with "Only test the login details" or "Dry run".
Checking the result: After the migration it is your responsibility to check that the destination is complete and to review errors and warnings in the log.
Lawful use: The Service may not be used for spam, unauthorised access, password guessing or any unlawful purpose.

4. Delete options

The "Move: delete from source" and "Mirror: delete from destination" options delete messages permanently and irreversibly. The decision to use them and its consequences are entirely yours.

5. Disclaimer of liability

To the fullest extent permitted by applicable law, Verinomi is not liable for any direct or indirect damage arising from the use of, or inability to use, the Service, including but not limited to:

loss, deletion, or incomplete, corrupted, duplicated or faulty transfer of messages, attachments, folders or flags;
the results of using the delete options;
a migration stopping halfway, delays, or interruptions of the Service;
limits, quotas, account blocks or security measures of the source or destination providers (e.g. Google, Microsoft, hosting companies);
loss of business, profit, reputation or data, or claims of third parties.

Given that the Service is free, no liability of Verinomi arises in any case except where mandatory law requires it. Liability for intent and gross negligence, and liability that cannot be limited by law, remain unaffected.

6. Changes and blocking access

Verinomi may change, suspend or discontinue the Service, its limits and these terms without prior notice. In case of suspected abuse it may stop running syncs and block access.

7. Personal data

Passwords are never stored; they are held in memory only while a sync runs. Message contents are never written to disk. The following records are kept:

Job log (server names, usernames, folder names, error messages): kept to provide support and deleted automatically after 7 days.
Consent record (date and time, IP address, source and destination account addresses and servers, selected options, version of the accepted terms and the result of the sync): kept to prove acceptance of these terms, protect legal rights in possible disputes and prevent abuse, and deleted automatically after 2 years.

These records are not shared with third parties; they may only be disclosed to competent authorities where required by law.

8. Governing law

These terms are governed by the laws of the Republic of Türkiye. In case of discrepancy, the Turkish version prevails.
